We have a HR policy that requires our employees to give us two weeks notice if they are going to leave us. Yesterday, I had a employee give me his two week notice. I would like to make today his last day and just pay him through today. Is that legal?
Answer: No, not according to the Massachusetts Attorney General’s office. The position for the Fair Labor Division is that if an employer requires employees to give the employer two weeks notice of his/her departure, the employer must pay the departing employee for that two week notice period even if the employer does not want the employee to work out the remainder of the notice period.
